No Appeal for Virginia Decision

Earlier this week, EPA said it will not appeal a potentially precedent-setting decision in a Virginia lawsuit. In January, a federal court ruled that EPA had exceeded its authority when it tried to control the flow of water to Virginia’s Accotink Creek in an attempt to manage sediment pollution. The state of Virginia and Fairfax County filed a lawsuit, arguing that, since water is not a pollutant, EPA did not have the ability to regulate it. Virginia’s attorney general also claimed that complying with EPA’s mandate could have cost the state more than $300 million.

The judge in the case agreed, saying that EPA can regulate pollutants within stormwater runoff but not the runoff itself—in other words, that it can’t use stormwater as a surrogate for pollutants.

There has been a great deal of discussion, both before the verdict and after, about the implications of the case. A thoughtful and thorough discussion appeared in this blog from Jon Devine of the Natural Resources Defense Council. Published after the verdict was issued, it strongly favors EPA’s position but argues that even if the decision stands, EPA still has effective tools available. (And among other things, he calls on EPA to “establish consistent national runoff pollution standards.”)
